1. Introduction
These Terms and Conditions (“Terms”) govern the provision of luxury limousine and chauffeur services by Limos of Sydney (“we,” “us,” “our”) to customers (“you,” “your”). By booking or using our services, you agree to be bound by these Terms.
Limos of Sydney operates under the regulations of the NSW Point to Point Transport Commissioner and maintains all required licenses and insurance for passenger transport services in New South Wales, Australia.
2. Definitions
“Service” means the provision of chauffeur-driven luxury vehicle transportation including but not limited to airport transfers, point-to-point transfers, and hourly hire services.
“Booking” means a confirmed reservation for Service made through our website, telephone, email, or other authorised booking channels.
“Customer” means the person or entity making the Booking and/or receiving the Service.
“Vehicle” means any motor vehicle operated by Limos of Sydney including luxury sedans, European sedans, SUVs, people movers, and sprinter vans.
“Chauffeur“ means the licensed professional driver assigned to provide the Service.
3. Bookings and Reservations
3.1 Booking Confirmation
- All bookings must be confirmed in writing via email or through our online booking system
- A booking is considered confirmed only when payment has been received or payment details have been authorised
- We reserve the right to decline any booking at our discretion
3.2 Booking Information
You must provide accurate and complete information including:
- Pick-up and drop-off addresses
- Date and time of service
- Number of passengers
- Special requirements (child seats, accessibility needs, luggage quantity)
- Valid contact telephone number
- Flight details (for airport transfers)
3.3 Amendments
- Amendments to confirmed bookings may be made up to 24 hours before the scheduled service time
- Amendments are subject to vehicle and chauffeur availability
- Changes may result in price adjustments based on the new service parameters
4. Pricing and Payment
4.1 Fare Structure
- All quoted prices are in Australian Dollars (AUD) and include GST (10%)
- Prices are calculated based on:
- Distance traveled
- Vehicle type selected
- Time of day/night
- Duration of hire (for hourly bookings)
- Applicable government levies and surcharges
4.2 Additional Charges
The following additional charges may apply:
- Night Surcharge: Services between 10:00 PM and 6:00 AM
- Government Levies: As mandated by NSW Point to Point Transport Commissioner
- Tolls and Parking: Actual costs incurred during the journey
- Waiting Time: Charges apply after the included waiting time
- Child Seats: Additional fee per seat when requested
- Cleaning Fee: $200-$500 if vehicle requires special cleaning due to spillage, damage, or illness
4.3 Payment Terms
- Payment is required at the time of booking unless credit account terms have been arranged
- Accepted payment methods include credit/debit cards (Visa, Mastercard, American Express) and online payment systems
- For hourly hire bookings, final payment will be calculated based on actual time and distance
- We reserve the right to place a pre-authorization hold on credit cards for the estimated fare amount
4.4 Corporate Accounts
- Corporate account terms are available for regular business customers
- Account applications require ABN/ACN verification and credit references
- Account terms are NET 14 days unless otherwise agreed
- Late payment fees of 2% per month apply to overdue accounts
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- More than 24 hours before pickup: Full refund (100%)
- 12-24 hours before pickup: 50% refund
- Less than 12 hours before pickup: No refund
- No-show: No refund and full fare charged
5.2 Operator Cancellations
- If we cancel your booking for any reason other than safety concerns or force majeure, you will receive a full refund
- Where possible, we will provide alternative arrangements or suggest alternative service providers
5.3 Refund Processing
- Approved refunds will be processed within 5-7 business days
- Refunds will be issued to the original payment method used for booking
6. Service Delivery
6.1 Pick-up Times
- Chauffeurs will arrive at the designated pick-up location at the scheduled time
- For airport transfers, we monitor flight arrivals and adjust pick-up times accordingly
- Included Waiting Time:
- Airport arrivals: 60 minutes from flight landing
- Other pick-ups: 15 minutes from scheduled time
- Additional waiting time will be charged at the hourly rate (pro-rata)
6.2 Journey Route
- Chauffeurs will take the most efficient route unless you request a specific route
- Route selection may be affected by traffic conditions, road closures, or safety considerations
- GPS navigation and real-time traffic monitoring systems are used to optimize journey time
6.3 Multiple Stops
- Multiple stops may incur additional charges
- Extended stops (over 10 minutes) will be charged as waiting time
- Security of unattended luggage or belongings during stops is the customer’s responsibility
7. Passenger Obligations
7.1 Conduct
Passengers must:
- Treat chauffeurs with respect and courtesy
- Not engage in threatening, abusive, or inappropriate behavior
- Comply with all reasonable requests from the chauffeur
- Not cause damage to the vehicle
- Not consume food or beverages without prior approval
- Not smoke or vape in the vehicle
7.2 Capacity Limits
- Passengers must not exceed the licensed passenger capacity of the vehicle
- Luggage must fit within the vehicle’s luggage capacity
- Child restraints must be used in accordance with NSW road rules
7.3 Prohibited Items
The following are prohibited in our vehicles:
- Illegal substances or contraband
- Firearms or weapons (except authorized security personnel with prior notice)
- Animals (except registered assistance animals)
- Items that may damage the vehicle or pose a safety risk
7.4 Right to Refuse Service
We reserve the right to refuse service or terminate a journey if:
- The passenger is intoxicated to the point of being a safety risk
- The passenger engages in threatening or abusive behavior
- Prohibited items are present
- The passenger refuses to comply with reasonable safety instructions
- Payment cannot be processed
In such cases, no refund will be provided and the full fare remains payable.
8. Liability and Insurance
8.1 Our Insurance
- All vehicles are comprehensively insured in accordance with NSW regulations
- Public liability insurance is maintained as required by the Point to Point Transport Commissioner
- Compulsory Third Party (CTP) insurance covers personal injury to passengers and third parties
8.2 Limitation of Liability
To the maximum extent permitted by law:
- Our liability for any loss or damage arising from the provision of Services is limited to the fare paid for that Service
- We are not liable for consequential losses including missed flights, appointments, or business opportunities
- We are not liable for delays caused by traffic, weather, road conditions, or other circumstances beyond our control
- We are not liable for loss or damage to passenger belongings unless caused by our negligence
8.3 Customer Liability
You are liable for:
- Any damage to the vehicle caused by you or your party
- Cleaning costs resulting from spillage, soiling, or illness
- Traffic fines or parking penalties resulting from your instructions or actions
- Loss or damage to our property
8.4 Luggage and Personal Property
- Passengers are responsible for loading and unloading their own luggage unless assistance is specifically requested
- We are not liable for loss or damage to luggage or personal property unless caused by our proven negligence
- Items left in vehicles should be reported immediately; we will attempt to secure and return items but cannot guarantee recovery
9. Force Majeure
We are not liable for failure to perform services due to circumstances beyond our reasonable control including:
- Natural disasters (floods, storms, bushfires)
- Industrial action or strikes
- Government restrictions or regulations
- Pandemic or public health emergencies
- Acts of terrorism or war
- Vehicle breakdown (provided alternative arrangements are offered where possible)
10. Privacy and Data Protection
10.1 Collection of Information
We collect personal information necessary to provide our services including:
- Name and contact details
- Payment information
- Travel details and preferences
- Flight information (for airport transfers)
10.2 Use of Information
Your information is used to:
- Provide and manage your bookings
- Process payments
- Communicate service updates
- Improve our services
- Comply with legal obligations
10.3 Data Security
- We implement appropriate security measures to protect your personal information
- Payment information is processed through secure, PCI-compliant payment gateways
- We do not store complete credit card details

11. Complaints and Dispute Resolution
11.1 Customer Feedback
- We welcome feedback and take all complaints seriously
- Complaints should be submitted in writing via email to our customer service team
- We will acknowledge complaints within 2 business days and provide a substantive response within 10 business days
11.2 Dispute Resolution Process
If you are dissatisfied with our response to a complaint:
- Request escalation to management level
- If still unresolved, we can engage in mediation through an independent dispute resolution service
- Disputes may be referred to the NSW Point to Point Transport Commissioner if appropriate
11.3 Governing Law
- These Terms are governed by the laws of New South Wales, Australia
- Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales
12. Regulatory Compliance
12.1 Point to Point Transport
- Our services are operated in accordance with the Point to Point Transport (Taxis and Hire Vehicles) Act 2016 (NSW)
- All chauffeurs hold appropriate licenses and clearances required by NSW regulations
- Vehicles meet all safety and maintenance standards required by law
12.2 Safety and Standards
- All chauffeurs undergo background checks and regular training
- Vehicles are maintained to manufacturer specifications and undergo regular safety inspections
- We maintain detailed service and maintenance records for all vehicles
13. General Terms
13.1 Entire Agreement
These Terms, together with our Privacy Policy and any booking confirmation, constitute the entire agreement between you and Limos of Sydney.
13.2 Amendments
- We reserve the right to update these Terms at any time
- Changes will be effective upon posting to our website
- Continued use of our services constitutes acceptance of updated Terms
- Bookings made prior to changes will be governed by the Terms in effect at the time of booking
13.3 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
13.4 Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it in the future.
13.5 Assignment
- You may not transfer or assign your rights under these Terms without our written consent
- We may assign or transfer our rights and obligations to another entity with notice to you
13.6 Communication
- Official notices will be sent to the email address or contact number provided in your booking
- You are responsible for keeping your contact information current
- Electronic communications are deemed received when sent
13.7 Consumer Rights
Nothing in these Terms limits or excludes any rights you may have under the Australian Consumer Law or other applicable consumer protection legislation.
